Kentucky Same-Sex Marriage Ban Held Unconstitutional
As I have previously discussed, a Federal judge in Kentucky previously ruled that Kentucky must recognize out-of-state same-sex marriages. On Tuesday Judge John Heyburn extended his previous ruling in a subsequent case.
In Love v. Beshear, Kentucky’s state ban on same-sex marriage was declared unconstitutional. Judge Heyburn held that the ban that prevents same-sex couples from marrying in Kentucky violates the Equal Protection Clause of the US Constitution, but stayed his ruling.
Special thanks to Edward J. Buechel (Raines, Buechel, Conley & Dusing, P.L.L.C.) for bringing this case to my attention.
