Indian Adoption Case Closed

As I have previously discussed, the U.S. Supreme Court recently decided in Adoptive Couple v. Baby Girl to uphold the adoption of a child by a South Carolina couple despite the biological father’s objection under the Indian Child Welfare Act.

The case now seems settled after the Supreme Court denied the Cherokee father’s plea to postpone the state court ruling authorizing the transfer of “Baby Veronica” to her adoptive parents, the Capobiancos.  Dissenters Ginsburg and Sotomayor noted they would have granted his request.
