Illinois & Medicaid Planning

In the case of Hines v. Department of Public Aid, 221 Ill. 2d 222 (2006), the Illinois Supreme Court decided that the state government could not seek reimbursement for payments made to a deceased recipient from the surviving spouse's estate.

In State can't dun surviving spouse's estate for nursing home bill, 94 Ill. B.J. 398 (2006), Helen Gunnarson discusses this case and concludes that this decision makes "the revocable living trust an even more attractive estate-planning tool."
