Ninth Circuit: Montana Statute Prohibiting Political Robocalls Violates First Amendment

In Victory Processing v. Fox, the 9th Circuit has ruled that a Montana statute prohibiting political robocalls runs afoul of the First Amendment, holding while the government may regulate the time, place, and manner of such calls, it may not regulate the content of such calls unless it demonstrates that the statute is narrowly tailored to serve a compelling state interest.
