Bar Discipline, Video Conferencing And Due Process

The Iowa Supreme Court has announced that it will issue a decision tomorrow in a matter that, among other concerns, raises the issue whether the complainant's testimony by video conference violated the  due process rights of the attorney. 

Iowa has a Grievance Commission rule on confrontation of witnesses that is implicated in the disposition of the issue. 

The hearing was conducted pre-COVID. 

The Grievance Commission recommends a 61-day suspension.

The attorney practices immigration law in Texas.

The Law Society of British Columbia is dealing with the issue of zoom hearings during the pandemic. There the Respondent seeks an in-person hearing. (Mike Frisch)
