Reports are out today of two probable nominees to the NLRB. According to Politico's Morning Report report, the president intends to nominate William Emanuel and Marvin Kaplan, and both are currently undergoing FBI background checks. Emanuel is an attorney at Littler Mendelson's L.A. office, while Kaplan has been working in the federal government, currently at the Occupational Safety and Health Review Commission and earlier as Republican counsel for the House Education and the Workforce Committee. An interesting note is that Bill Seaton had been rumored to be on the shortlist and it's possible that having worked as a "union buster" may have worked against him (or not, no one's saying at this point).

Marvin Elliot Kaplan is set to be reappointed this afternoon, but with less debate this time.
This is troubling.
In recent memory, have there been other candidates who never held ABA leadership positions or positions with any other labor law group? Ever been a Republican member who had not established his competence by becoming partner of a firm, or at least represented a party before the Board? Never even wrote an article about it?
Did Kaplan do well at Wash U? At what firm did he perform his "brief stint" in private practice?
Who got him his job plum as a "special assistant" in 2006 with the DOL-OLMS where he reported to another plum job holder?
Who got him his plum job at OSHA Review Commission?
Is Kaplan's family politically connected?
Well, his father, Elliot Kaplan, was a big supporter of Lt. Governor Dave Owen in the 80's. So much so that both were charged with felonies. Charges eventually dismissed, except for one that stuck on Dave Owen until he was pardoned by Bill Clinton.
Marvin himself does not have a big record of financially supporting candidates. He did support Jim Talent in 2002. Marvin's father Elliot, mother Jean and some other relatives supported Talent that years. Each gave exactly $1000 in a pretty short period of time. Jack Abramoff gave $3000 that year; Talent returned it in 2005.
Lee Kaplan of St. Louis and the Enterprise-Car-Rental PAC seem to be the biggest hitter of Kaplan contributors; but is Lee related to Marvin and Elliot? Well, let's put it this way: David Owen gave to the Enterprise-Car-Rental PAC in 2005-2007.
So, the answer is clearly that Kaplan has family with political pull.
In light of the severe lack of qualifications that Marvin Kaplan brought with him to the job, it anyone worried about what would appear to be the handing over of this position to someone's favorite nephew?
Is Kaplan at least recused from Enterprise-Car-Rental cases?
