FMLA Insights Podcast: When Does Additional Leave Beyond FMLA Need to be Granted?

FMLA Jeff Nowak of Franczek Radelet in Chicago has brought to our attention a new post on a recurring FMLA issue.

In the January FMLA Insights podcast, one of the most common inquiries they receive from their clients is how they should handle a situation where an employee has exhausted 12 weeks of FMLA leave and now seeks additional leave (or where his/her return date is still uncertain). 

In light of a broadened ADA as well as recent aggressive initiatives by the EEOC in this area of the law, Jeff's firm advises employers to individually assess the employee's need for leave and any return to work issues before deciding to terminate employment.  In the podcast, they offer practical tips on how to handle these situations.

Jeff also points out that with the turn of a New Year, it is a good time to update your FMLA policy as to the October 2009 FMLA military leave amendments that went into effect this past fall.
