A Civil Rights Act of 2010?

Paul Salvatore (Proskauer Rose) and Paul Secunda think it's a strong possibility.  An article in yesterday's Employment Law 360 (subscription required) quotes Paul S. as saying:

[T]wo pro-employer rulings from this term, coupled with several other unpopular decisions by the court in the past two or three years, ha[ve] the potential to provoke sweeping remedial legislation.  “We might see a broad-based bill that corrects a bunch of recent Supreme Court decisions, something like a Civil Rights Act of 2010,” he said.

If the Congress is constantly trying to correct the SC, doesn't this argue against the Conservative wing's view that they're interpreting under original intent?
