Aditi Shah on Lawfare considers "The Role of Federal Courts in Coronavirus-Related Immigration Detention Litigation." She notes that, "[f]rom the outset, the coronavirus pandemic posed a unique and immediate threat to incarcerated people—including noncitizens in civil immigration detention. As the pandemic goes on, lawsuits have proliferated across the country challenging the inadequate response of Immigration and Customs Enforcement (ICE) to the spread of the coronavirus." Shah concludes that it is uncertain what impacts the detention litigation in the time of COVID-19 will have on the long term trajectory of immigrant detention litigation.
