Secretary of DHS Issues Two Memoranda Implementing President Trump's Immigration Enforcement Executive Orders

Secretary of the Department of Homeland Security John F. Kelly has issued two orders implementing President Trump's immigration executive orders of January 25, 2017:

Implementing the President's Border Security and Immigration Enforcement Improvement Policies

Enforcement of the Immigration Laws to Serve the National Interest

Peter Margulies has a thoughtful analysis on LawFare of the Due Process questions raised the expansion of the use of "expedited removal" of noncitizens in the two memos.  He observes that

"Department of Homeland Security (DHS) Secretary John Kelly has just sent two memos to the White House for review that could fundamentally reshape U.S. immigration enforcement and exacerbate tensions with Mexico. The memos lay the groundwork for reducing procedural safeguards on removal of noncitizens through expanded use of 'expedited removal' procedures."

Jill Family also criticizes the Trump administration's "due process sleight of hand" in expanding expedited removal.
