Ninth Circuit Rules in Favor of Immigrant Minors

Hurwitz

The U.S. Court of Appeals for the Ninth Circuit today decided Flores v. Lynch.  In an opinion by Judge Andrew Hurwitz, and joined by Judges Ronald Gould and Michael Melloy (sitting by designation from the Eighth Circuit), affirmed in part Judge Dolly Gee's order allowing for the release of minors, booth accompanied and unaccompanied.  The release of adults was found to be outside  the scope of the settlement.

The case was argued in early June.  Here are some background materials about the case, which currently revolves around a 1997 settlement agreement.  For further discussion of the case, click here.
