US Seeks Stay in in Fifth Circuit in Texas v. United States
The U.S. government today sought an emergency stay of the district court's preliminary injunction in Texas v. United States. As previously reported on ImmigrationProf, the disrict court denied a stay request by the Obama administration.
Among other things, the United States contends that the injunction should be stayed pending appeal because the district court ruling was "wrong." "At a minimum, the injunction should be stayed with respect to: (1) States that are not parties to this suit; and (2) plaintiff States other than Texas."
