Kevin Johnson and I considered this prospect a couple years back in Johnson & Hing, The Immigrant Rights Marches of 2006 and the Prospects for a New Civil Rights Movement, 42 Harv CR-CL L Rev 99 (2007). Which constitutional civil right is at stake? If it's a right to immigrate illegally, only our border scoffers support it. There is no serious worldwide support for unregulated immigration, a point that refutes the likelihood of accepting such proposals. Such movements lack moral and legal legitimacy. Only crazed ultra left wingers support amnesty and a pathway to citizenship.
