Legal Geography of Fake Pesticides in Chinese Courts, 1997-2017

Francis Snyder (Peking University), Legal Geography of Fake Pesticides in Chinese Courts, 1997-2017, Pecking U. Sch. Translational L. Res. Paper (2023):

This paper sketches the legal geography of cases concerning fake pesticides in Chinese courts from 1997 to 2017, the period of the first major pesticide legislation in China. It shows which cases were decided, which areas of law were involved, and identifies long-distance trade in fake pesticides as an outstanding policy issue. It also offers a new definition of 'fake' pesticides, revising commonly accepted definitions of intellectual property in the matter by referring to singularities and consumer protection.
