Applying Ne Bis in Idem to Commission Proceedings Implicating Article 11(6) of Regulation 1/2003: Case C-857/19 Slovak Telekom

 
The Court of Justice ruled that the principle of ne bis in idem is inapplicable (i) where proceedings are initiated against or fines are imposed on an undertaking separately and independently by the Commission and a national competition authority for infringements of Article 101 or 102 TFEU relating to separate (product or geographical) markets or (ii) where, due to Article 11(6) of Regulation No 1/2003, a national competition authority is relieved of its competence to apply competition law.
