Belgian Prohibition of Abuse of Economic Dependence Enters into Force

Key Points
  • The new prohibition covers abusive practices engaged in by firms with relative market power viz-à-viz other firms.

  • The abusive practices mentioned in the legislation are akin to conduct that would be abusive for dominant firms but may be broader than that.

  • Fines of up to 2 per cent of turnover can be levied by the Belgian competition authority; private actions before the courts are also possible.
