ABSTRACT: Documents exchanged between the European Commission and a National Competition Authority (NCA) for the enforcement of the EU antitrust rules benefit from a general presumption that they should not be accessible to the general public as the disclosure of such documents would undermine the protection of the commercial interests of the companies involved as well as the protection of the investigation of the NCA concerned.
