The past year has
seen an increase in private antitrust litigation across Europe, with
claimants focusing particularly on London and the German courts. Most
private actions for damages settle and not infrequently defendants face
claims in a number of jurisdictions. The position and role of the
individual in cartel proceedings and subsequent litigation are becoming
increasingly important considerations.
These and other issues, such as damages and access to the commission's
