This article should be mandatory reading for corporate lawyers. In his essay, Attorney Jack Fernandez provides a framework for analyzing those situations where it is or is not appropriate to indict a lawyer for his legal advice. But in the course of addressing that question, Fernandez explores the difficulties facing lawyers in advising clients facing tough business decisions, particularly in heavily regulated industries, as well as decisions which have the potential for catastrophic consequences. He offers his essay as a starting point for further discussion and it is an excellent start at that.
