According to the Topeka Capital-Journal here, prosecutors have decided to proceed with a case against former CEO of Westar Energy, David Wittig, and former executive vice-president Douglas Lake. The first trial was a mistrial. The second trial, which resulted in a conviction, was reversed by the appellate court. Wittig had received a sentence of 18 years, and Lake 15 years when the court decided to reverse the fraud convictions. (see here) The reversal came in a case with an incredible analysis using the "legally compelled mailing doctrine." But now the prosecution wants to try for three.
