The American Association of Real Property, Trust and Estate Law is sponsoring a webinar entitled, Peierls of Wisdom: An Analysis of the Delaware Supreme Court Peierls Opinions and Their Impact on the Migration of Trusts to Delaware, on Thursday, January 9, 2014. Provided below is a description of the event:
On October 4, 2013, the Delaware Supreme Court issued three separate and related en banc opinions for the Peierls matters, authored by Chief Justice Steele, resulting from the appeal of three opinions of the Delaware Court of Chancery. The Delaware Supreme Court opinions provide significant insight into various legal issues that should favorably impact the migration of trusts to Delaware and the subsequent modification of those trusts to take advantage of Delaware trust law. Our panelists, who represented the Peierls family in both the Chancery Court and Supreme Court actions, will:
- Explain the prior Consent Petition Practice in Delaware;
- Summarize the key holdings of the Delaware Supreme Court opinions;
- Explore the impact of the Supreme Court decisions on the methods for modifying trusts under Delaware law; and
- Discuss common reasons why non-Delaware residents utilize Delaware trusts and how a trust may be modified under Delaware law in order to take advantage of Delaware's statutes.
