Florida’s Surviving Spouse Rights


Craig Dreyer (Clark Skatoff PA) recently compiled a synopsis of rights and benefits that Florida law grants surviving spouses. 

This synopsis details intestacy, pretermitted spouses, homestead rights, elective shares, family allowances, exempt property, community property, social security death benefits, and marital agreements as they relate to surviving spouses in Florida.

Attorneys should be aware of the short timelines provided by Florida statutes, as the failure to meet these probate deadlines can cause a surviving spouse to lose their spousal entitlements.
