Article on the Pay-for-Play Dilemma

Austin-dragooAustin J. Dragoo (Florida Coastal School of Law) recently published his article entitled 'Trust' This: A 'Fitting' Solution to the Pay-for-Play Dilemma, 2012.  The abstract, available on SSRN, is below: 

With seemingly everyone in collegiate athletics reaping the benefits of student-athletes’ hard work and sweat equity, the time has come to share the wealth with student-athletes. A multitude of proposals exists for how to compensate student-athletes, but few provide the flexibility and minimization of potential risk to the NCAA as well as a trust. Increasing litigation and calls for reformation of the NCAA’s policies have led this author to review some of the proposed solutions and compare those solutions to implementation of a proposal that establishes a trust for student-athletes to distribute to those athletes after graduation. This article examines some of the legal issues that have dissuaded the NCAA from instituting a full-fledged solution and examines how a trust might solve or minimize the NCAA’s risk from in various areas of the law.
