Article About Getting Paid in Probate Court
Robert Augsburger recently published his article entitled Getting Paid in Probate Court, 44 St. Mary's L.J. 425 (2013). The introduction to the article is below:
After reviewing the Texas Probate Code, Texas Property Code, and current case law, this Essay compiles relevant information designed to assist attorneys in obtaining payment for services provided to their clients. Attorneys commonly act as attorneys ad litem, provide professional guardianship services, engage in will defense, and create trusts for guardianships. However, there are limited bases for recovering attorney's fees. Navigation of the Texas Probate Code, Texas Property Code, and current case law provides the roadmap for attorneys to obtain fees incurred and retain monies earned while assisting others in a time of need.
