Majali's Family Asks Court to Set Aside Arbitration Award
Sandile Majali, ANC benefactor, passed away and now his
family is asking the Johannesburg High Court to set aside an arbitrator’s
decision awarding ownership of Siyanda Chrome Investments to Lindani Mthwa.
Majali and Mthwa each claimed to hold all shares in the company. In October 2010, without hearing representations by Majali, an arbitrator decided that Mthwa owned all of the company. Majali did bring an application to set aside the award, but he died in December 2010 before the court could hear the application. A spokesperson for the executors told the court that it could intervene if “an arbitrator had committed gross irregularity, exceeded his powers or when an award was improperly obtained.”
