Paying Back Medicaid with Personal Injury Recoveries

FriedmanLawrence A. Friedman (Certified Elder Attorney, New Jersey) has published his article entitled Medicaid and Medicare Liens in Personal Injury Settlements, J. Nat'l College of Probate Judges, Spring 2010, at 8.  

The article discusses the following:

  • Medicaid's ability to claim against personal injury recoveries for health care expenses incurred due to a tort.
  • A Medicaid recipient's liability for claims plus interest if the recipient doesn’t notify Medicaid of a tort recovery. 
  • Uncertainties in calculating Medicaid recoveries and specifically, whether the recovery includes funds for future health care expenses relating to the personal injury.

I have a client who lost his job after back injuries. He was unable to get Medicaid to help out, I was wondering what would his options be at this point?
