Tort Law or Worker's Comp for Workplace Shooting?
A Florida wrongful death suit is testing the reach of the state's worker's compensation statute. The suit against Publix alleges that the store had no policy or procedure for dealing with workplace violence, and that the resulting shooting by an ex-employee was "substantially certain to occur." The plaintiff's lawyer argues that the state's worker's comp law should not apply because it amounts to an "unconstitutional denial of access to the courts."
