First Amendment Challenge to FDA's Off-Label Use Prohibition
Bloomberg reports that Allergan has sued the FDA and Justice Department challenging FDA rules that prohibit manufacturers from promoting off-label use. The complaint seeks a preliminary injunction barring enforcement of the rules.
