There's an interesting update to the Harvard closed claims study in the new New England Journal of Medicine. They conclude that there's not really a problem with frivolous lawsuits, and that most of the money involved in med mal goes to litigating and paying for medical errors. Also, med mal litigation overhead is "exorbitant."
