Denver Judge: Actors May Not Smoke on Stage

A Denver, Colorado judge has ruled that actors may not light up on stage in violation of a state-wide ban on smoking. The Colorado statute bans the use of tobacco and clove and other plant materials packaged for smoking. The theaters which challenged the ban had sought to use tea leaf cigarettes as a substitute and had requested a preliminary injunction. Judge Michael Martinez said, ""From the testimony I`ve heard, the plaintiffs have failed to demonstrate that smoking in the theater constitutes expressive conduct." Read more here.
