Public Defender Allowed Misuse Of Public Funds

The South Carolina Supreme Court has imposed a suspension of 18 months retroactive to the attorney's August 2011 interim suspension.

The attorney was the Circuit Defender for the Anderson County Public Defender Office. He was arrested and charged with habitual neglect of his duties by allowing misuse of public funds for his own gain and "by improperly supervising and approving fraudulent or exhorbant [sic] expense reimbursements."

The criminal charges were dropped (and all records expunged) after the attorney completed the requirements of a pretrial diversion agreement. He completed 50 hours of community service with Habitat for Humanity.

He had prior public reprimand for failure to file a federal income tax return.

The court here approved a consent agreement for discipline. (Mike Frisch)
