"Shockingly Insensitive"

The Arizona Presiding Disciplinary Judge approved a consent disposition of a 30 day suspension and continued probation of an attorney for misconduct in civil litigation.

The attorney sent a letter to the opposing party that had no purpose other than to embarrass and harrass, filed frivolous pleadings, advised his client to not attend a scheduled medical examination and engaged in "insulting and shockingly insensitive" questioning at a deposition.

The attorney failed to advise the client of the consequences of her failing to attend the medical examination. She was sanctioned as a result. (Mike Frisch)
