Relief Reversed
The Rhode Island Supreme Court has held that a motions judge improperly granted post-conviction relief to a defendant who claimed that his trial counsel labored under an impermissible conflict of interest. The lawyer had simultaneously represented a co-defendant in the criminal case on an unrelated matter. The court concluded that the claim was barred both on procedural and res judicata grounds.
