"Shocking Disregard"
The New York Appellate Division for the First Judicial Department ordered the interim suspension for an attorney who had failed to cooperate with an investigation into two complaints alleging possible misuse of entrusted funds:
The Committee's motion for an interim suspension should be granted
since respondent's failure to comply with the Committee's lawful
request for documentation, to respond to its subpoena and to answer the
second complaint evinces a shocking disregard for the judicial system
which can only be interpreted as a deliberate and wilful attempt to
impede the Committee's investigation. Accordingly, suspension pursuant
to 22 NYCRR 603.4(e)(1)(i) is warranted.
