The New York Appellate Division for the Third Judicial Department denied the application for bar admission of a 41 year old attorney, admitted in Colorado, who has had a longstanding problem with alcohol and chemical abuse. The applicant had both a criminal and bar discipline record in Colorado, the most recent bar action resulted in reinstatement with conditions in 2005. The court commended the applicant's progress with his substance abuse problems and indicated that admission may be appropriate upon his unconditional reinstatement in Colorado, where the conditions were imposed for a five year period.
