Absence Of Retainer Agreement No Bar To Fee Recovery

The New York Second Judicial Department affirmed a judgment awarding a law firm unpaid fees in an action against a former client. The defense based on the absence of a written retainer agreement was rejected because the representation had commenced before New York adopted a rule required a writing setting forth the fee agreement.
