Lawyers Suing Lawyers

A law firm sued another law firm for misconduct by an associate of the defendant firm. The associate had intercepted telephone calls from potential clients and obtained information regarding the legal services sought by pretending to be associated with the plaintiff firm. The associate was convicted of criminal impersonation and disbarred. On appeal, the New York Appellate Division, First Judicial Department upheld the claim for compensatory damages for the lost business but overturned the punitive damage award against the defendant firm.
