It is worth noting that, although all government generated scientific publications enter the public domain, the value any company or person adds to them can obtain a copyright or patent. Such a distinction might be important to a researcher giving attribution. Interestingly, state and local governments operate under no § 105 restraints and, thus, can exploit copyright. But, even local and state statutes, regulations, and judicial opinions are not copyrightable. Furthermore, internationally, the opposite public policy exists. For instance, most of the European Union and Canada claim crown copyright and exploit their own publications. Such a policy has negatively impacted innovation and development.
