D.A. Horton Appealed to 5th Circuit

NlrbADR Prof Blog reports today that the NLRB’s decision in D.A. Horton, limiting arbitral class waivers in employment agreements, has been appealed to the Fifth Circuit.  Given the political conservatism of the Fifth Circuit, I suspect that the only real question is how long it takes the court to reverse.
