Reading Tea Leaves on San Francisco Preemption Decision

Sanfran Of course, one of the big ERISA preemption cases that remains to be decided is whether the City of San Francisco can go forward with its universal health care program.  You may recall that a 9th Circuit panel issues a stay of a district court's decision enjoining the program based on preemption grounds.

Now comes word from Business Insurance magazine that the same panel that issued the stay will also be hearing the case on the merits.

Can't be a good sign if you are the Golden Gate Restaurant Association.
