New Court Decision from Germany
Germany’s Federal Constitutional Court ruled that state laws banning smoking in bars are unconstitutional because they discriminate against one-room bars.
Germany regulates smoking in public places on a state-by-state basis in Germany, and most states allow bars to designate a separate room for smokers. But the court found that these laws discriminate against one-room bars. The court said that the states must either ban smoking in all bars or create exemptions for smaller businesses.
