ABA Resolution on Post-Departure Bar on Motions to Reopen or to Reconsider

Jill Family (Widener) reports from the ABA Annual Meeting in Toronto that yesterday the American Bar Association adopted a Resolution supporting the elimination of the post-departure bar on filing motions to reopen or to reconsider removal proceedings in 8 C.F. R. § 1003.2(d). The Immigration Committee of the Administrative Law Section drafted the Resolution, which won the support of the Administrative Law Section and then was adopted by the ABA House of Delegates. Jill, Dan Kanstroom (Boston College) and Rachel Rosenbloom (Northeastern) coordinated the effort.
