Jesner: Will SCOTUS Find Corporate Liability for Human Rights Violations?

NYU's Just Security is hosting a series on the upcoming Supreme Court Case of Jesner v. Arab Bank.  Jesner raises the issue of whether corporations can be sued for human rights under the Alien Tort Act. This was the question left unanswered in Kiobel v. Royal Dutch Petroleum Co

As Just Security notes, the questions raised include:

1) whether customary international law permits corporate liability;

2) whether, as a matter of U.S. domestic law, the ATS cause of action should be interpreted to permit corporate liability;

3) whether the case against Arab Bank should be dismissed on some other ground.
