A Christmas Story from the Attorney at Large

A Christmas Story, Compliments of the PA Supreme Court

“Merry Christmas, Nedster,” I greeted my attorney-friend Ned McAdoo, as I approached his table in Havertown’s Sampan Inn. Why he had selected sushi for our final weekly lunch of year was a mystery to me… until I spied the warm sake on the table.
“Ho, ho, ho,” Ned responded, obviously a couple of belts of the clear, warm rice wine ahead of me. He was reading this week’s Legal Intelligencer. “I love a good Christmas story, don’t you?”
“Sure,” I said, slipping into my seat. “Who doesn’t?”
Sipping his sake, Ned continued, “Here’s one to share with the kiddies around the tree this year.” Without further ado, he shared the report of a case decided by our Supreme Court in mid-October. In Commonwealth v. Rega the Supremes confirmed the defendant’s conviction for first-degree murder. His crime was committed on December 21, 2000. According to the court, the facts were these:
“On December 21, 2000, at about 9:00 in the evening, Appellant [Rega] and his friends Stanford (Stan) and Susan Jones (Susan), who were married, and Shawn Bair (Bair) were at Appellant's trailer residence bemoaning their lack of funds for Christmas presents for their children. Appellant devised a plan to rob the Gateway Lodge, where both he and Bair previously worked as night watchmen. Due to their prior employment, Appellant and Bair were familiar with the Gateway Lodge and knew that there was a safe and an ATM machine, both of which contained substantial amounts of cash. The participants intended that during the robbery, nobody would get hurt.”
Susan stayed home to baby-sit, while the three men, plus a fourth they recruited, armed themselves with a butcher knife and a gun, donned stocking masks and gloves, and set off for the lodge. The plan was to corner the night watchman inside and force him to lure the owner into the office, where she would help them access the ATM.
Anyone who has done last-minute holiday shopping knows that things can get hairy in a hurry. This little trip was no exception. The watchman was encountered outside… no huge problem for crooks driving something other than a 1989 Buick badly in need of bodywork. Not dissuaded by the near-certainty that the watchman could ID the car, the foursome leaped out and subdued him.
Once inside they forced the watchman to ring up the owner. On his first try--- perhaps due to the proximity of the butcher knife to his throat --- he rang up a wrong number. On try two he got the owner’s answering machine. Perhaps she herself was at Target, picking up a few last-minute gifts.
“By now,” commented Ned, “alarms in all these guy’s heads should have been screeching ‘abort, abort.’ But no…”
Instead, in the court’s words, “The group proceeded to the room where the safe was kept. After locating it under a desk, Stan and Fishell began to move it while Appellant held Lauth [the watchman] at gunpoint. Appellant radioed Bair to tell him to pull Stan's Buick up so they could load the safe into it. As Fishell and Stan carried the safe to the car, Appellant fired several shots at the ATM in an unsuccessful attempt to break into it. The group also cut various wires in the office because they were concerned about police being notified somehow.

“After failing to gain entry to the ATM and then cutting the wires in the office, Appellant moved Lauth into the kitchen at gunpoint. Fishell and Stan joined Appellant and Lauth. Upon Fishell and Stan's appearance in the kitchen, Appellant hit Lauth with his flashlight and then handed it to Fishell, instructing him to hit the victim. Fishell hit Lauth one time. Appellant then fired the gun at the freezer door in an attempt to open it. To escape any potential ricochet, Fishell returned to the car. At the same time, Stan found Lauth's vehicle in the parking lot and drove it over the hillside down an embankment, and then he returned to the car. Bair was still in the car, acting as a lookout. While Stan, Fishell, and Bair waited in the car, they heard a gunshot, a scream, a gurgling sound, and then another couple of gunshots. Appellant ran out of the building, got into the car, and directed Bair to drive….
“After arriving at Appellant's trailer, they used a grinder to open the safe. The group, along with Susan, separated the items from the safe and split the money four ways, about $5000 each. Appellant then instructed the group to put all credit cards and papers they found in the safe back into it, and took it to the car. They stuffed a kerosene soaked blanket into the safe, lit it on fire, and dumped it down an embankment…. Later in the day on December 22, 2000, Appellant gave his gun, wrapped inside a bag, to Stan. Stan put the wrapped gun in his car, drove away with his wife Susan, and threw the gun into a creek.”
The justices didn’t say whether the Stan and Susan went to the nearest Wal-Mart and loaded up on Christmas goodies for their kids. We do know that Rega bought himself a holiday gift… a second-hand Dodge Neon, which he paid for in cash. His sudden cash position was one reason the cops caught onto him.
“When I read this stuff, buddy,” I told Ned, taking a big swig of the sake myself, “I don’t know whether to laugh or cry.”
“Like I said, Seamus,” Ned toasted me with his little sake cup, “Ho, ho, ho.”

A personnel change at NACUA

Dear Colleagues --

By now, I think you all know that Linda Henderson will be leaving us
after 20 wonderful years of service to NACUA to take on a part-time
position with NACUA member Steve Hirschfeld and the Employment Law
Alliance, as well as to continue to pursue her many volunteer interests.
Linda has also indicated that she is willing to continue to do some
part-time work for us on publications as we think about our next steps.
Her last day in the office will be January 4, 2008, and we thought that
the most meaningful gift she could receive would be a scrapbook with
comments from the many authors and members with whom she has worked over
the years. That's where I need your help!

You have authored a publication and I am asking you to submit any
comments about Linda and her work (serious, funny, anything) to Abigail
Horton in my office by Friday, December 21, 2007. Abigail will then
compile the comments that we will present to Linda at a luncheon on her
last day. Linda has been of great service to NACUA and a comment or
story from you would mean a lot to her. Thanks so much for your

Education Institutions in The State of Louisiana


New contract streamlines buying process to implement a mass notification
system

LEESBURG, VA - December 12, 2007 -OmnilertT, LLC, maker of the leading
emergency notification system for higher education called e2CampusT, today
announced they have been selected by the State of Louisiana to receive an
award for a State Contract for Emergency Notification Services.

The Emergency Notification Service State Contract is an
indefinite-delivery-indefinite-quantity (IDIQ) contract established by the
Louisiana Office of State Purchasing. This contract is available to all post
secondary institutions and other emergency preparedness or campus based
organizations within the State of Louisiana. This includes state colleges,
state universities, fire departments, police departments, and other

estimated to start January 1, 2008.

"This contract allows a government organization to order pre-competed

Services to be provided under the contract include all components of an

A new book on military history hot off the press

Dear Friends:

On Monday, I received a package containing two shrink-wrapped
covered copies of Edward G. Longacre and Theodore J. Zeman, eds., Beyond
Combat: Essays in Military History in Honor of Russell F. Weigley
(Philadelphia: American Philosophical Society, 2007). It is a beautiful
book, coming in at 271 pages in length. It contains a biographical foreword
by the two editors, an introduction by Dennis F. Showalter, important essays
by nine of Russ Weigley’s PhDs, a select bibliography of Russ’ work
(including all his known conference papers and public history addresses),
and an index. There is also a photo section showing Russ engaged in thought
and conversation. You can almost see the wheels turning inside his head.
The book’s table of contents is reproduced below.

Ed, Ted, and their contributors not only deserve high praise for
the quality of their work, but also for their generosity in donating the
time and talent required to make this wonderful volume possible. It is a
fitting monument to Russ and his legacy. In addition, the editors have
arranged for the royalties from sales of Beyond Combat to be donated to the
Center for the Study of Force and Diplomacy at Temple University, which Russ
founded. I was always struck by the pride Russ evinced in his former
students. Beyond Combat is just another piece of evidence that shows how
much that pride was justified. It not only demonstrates the intellectual
vitality of Temple’s graduate program in military history, but also the
degree of character that sets it apart. I only hope that my students and I
can perpetuate that part of the Weigley legacy as well.

To that end, I have applied to the College of Liberal Arts for a
grant to hold a one-day conference on Saturday, 26 April 2008, showcasing
Beyond Combat and the Temple tradition in military history. The Society of
Military History, American Philosophical Society, Roxanne and Jack
Satterfield, and Boeing Corporation have signed on as co-sponsors and
pledged to cover more than half of the conference’s costs. We are still
waiting to hear from CLA if it will fund the rest of the conference (and we
will probably not get the word until mid-January 2008). Four of the book’s
contributors have agreed to present paper versions of their essays. There
will be a round-table discussing the future of military history that will
feature those four presenters and Ed and Ted (and any other Weigleyite who
cares to show up).

married to Dr. Bali Amjad who was a wealthy cocoa merchant in Ivory Coast for
years before he died in the year 2004. We were married for eleven years without a
child. He died after a brief illness that lasted for only two weeks. Before his
death we were both faithful Muslim.

Since his death I decided not to remarry or get a child outside my matrimonial home
which the holy Quran is against. When my late husband was alive he deposited one
truck box with a security company here in Abidjan which is valued of 10.5 Million
USD.

Presently, though my late husband did not tell the security company what is inside
the truck box. Recently, my Doctor told me that I have serious sickness which is
cancer problem. The one that disturbs me most is my stroke sickness.

Having known my condition I decided to donate this fund to a Islamic institution or
individual that will utilize this money the way I am going to instruct herein. I
want a Muslim that will use this fund for orphanages home, hospital, mosque,
school,esepcially for this coming Ramadan and propagating the word of mighty Allah
and to endeavour that the house of mighty Allah is maintained. The Holy Quran made
us to understand that Blessed is the hand that gives. I took this decision because I
don’t have any child that will inherit this money and my husband relatives are not
here in this country and I don’t want my husband’s efforts to be just loosed like
that. I don’t want a situation where this money will be used in an ungodly way. This
is why I am taking this decision. I am not afraid of death hence I know where I am
going. I know that I am going to be in the bosom of the mighty Allah.

As stated in the Holy Quran (Surah xxxvi Yasin) Thou wariest only him who followeth
the reminder and fearieth the beneficent in secret to him bear tiding of forgives
and a rich reward. I don’t need any telephone communication in this regard because
of my health. With mighty Allah all things are possible. As soon as I receive your

you and the Islamic institution to always pray for me because the mighty Allah is my
shepherd.

My happiness is that I lived a life of a worthy Muslim. Whoever that wants to serve

Franklin and Marshall College gets into Bioinformatics

Clinic Partnership: MacArthur “genius award” winner D. Holmes Morton, M.D.,
founder and head of the Clinic for Special Children in nearby Strasburg, along with
the other members of his staff, has joined the F&M faculty to develop a program in
bioinformatics that integrates genetics, computer science and biochemistry. At his
clinic, Holmes and his staff conduct research and develop medical treatments for
genetic disorders that afflict some children in the Amish community.

Dividing their time between the new cell and molecular biology teaching laboratory
in the Barshinger Life Sciences and Philosophy Building and Holmes’ clinic,
students work side by side with clinic staff, conducting research, analyzing data,
and mapping and predicting disease rates. Students get a firsthand look at patient
care, and observe how physicians deal with the health problems of these special
patients. Clinic researchers will also offer lectures in molecular genetics,
evolution, bioethics and public policy.

“Most of the work we do is very difficult, complex biology that takes a long
period of time,” says Morton. “Students need to get an idea of what medicine
allows you to do.”
