Inheritance for Out-of-Wedlock Children in Japan

The decision delivered Wednesday by the Supreme Court, which states that the Civil Code stipulation dis-criminating against children out of wedlock in terms of inheritance is unconstitutional, clearly stated that the ruling would not affect disputes that have already been settled.

The decision is based on a sound judgment that opening old cases would cause confusion. However, there is concern that children born out of wedlock entitled to only half of the inheritance other children are entitled to may feel the decision is unfair and take action.
