Stay of DC Same-Sex Marriage Denied

Ruthann Robson of the Constitutional Law Prof blog notes that “the United States Supreme Court has deferred deciding on constitutional challenges to same-sex marriage in DC.”  She notes that, as Circuit Justice for the DC Circuit, Chief Justice Roberts refused to grant a stay of Washington, DC’s Religious Freedom and Civil Marriage Equality Amendment Act, which allows same-sex marriage.  The case is Jackson v. District of Columbia Board of Elections and Ethics, 559 U. S. ____ (2010), and the opinion is available here.
