Burying Streams Beneath Mountain Top Coal Mining Rubble
The Fourth Circuit concluded last week
that the Corps properly concluded that burying streams beneath mountain top coal mining rubble has a minimal environmental impact -- reversing Judge Goodwin's decision that had revoked 11 Corps of Engineer permits issued pursuant to Nationwide Permit 21. 4th Circuit opinion NYTimes: Mountain Top Mining Presumably, the Kentucky citizens who sued the Corps will seek rehearing or rehearing en banc.
