Erik Encarnacion has posted Backpay for Exonerees (Yale Journal of Law and the Humanities, Vol. 29, No. 2, 245) on SSRN. Here is the abstract:
Argues that just compensation for exonerees can be determined by assuming that innocent prisoners are entitled to backpay for services rendered: criminal deterrence services. This inquiry also helps affix a dollar value owed to each exoneree per year of incarceration, which might be upwards of $170,000.
