Death penalty, race of victim, and relationship of victim to law enforcement officers

My colleague at the University of San Diego, Shaun Martin, has this post at his California Appellate Report taking issue with a recent unanimous decision of the California Supreme Court rejecting defendant's claim that he made a sufficient showing to justify discovery on the victim-race issue and implying that proof that defendant's death penalty was motivated by his victim's relationship to law enforcement would not violate the equal protection clause.
