Moreham on Physical Privacy in English Law

N. A. Moreham (Victoria University of Wellington - Faculty of Law) has posted Beyond Information: The Protection of Physical Privacy in English Law on SSRN. Here is the abstract:

To date, the focus of English privacy law has been on the protection of private information. This paper considers whether and how privacy protection should be extended to privacy intrusions which do not involve the dissemination, or even the collection, of private information. Following a theoretical analysis of the privacy interest, the paper identifies existing protections for physical privacy in English law and considers how the breach of confidence and/or misuse of private information actions should be extended to enhance them.
